Kator, Parks, Weiser & Harris, PLLC, has filed a class action against the USDA Food Safety and Inspection Service.  FSIS’s rules prohibit any employee working in an Alternative Duty Assignment (due to a workplace injury) from working any overtime or on holidays.  The class action alleges that this FSIS policy discriminates against disabled workers.

The class action has been filed with the EEOC, and class certification is pending review.
