May 20, 2003 Update

On April 7, 2003, the Equal Employment Opportunity Commission issued its final decision in the Campbell appeal denying his request for reconsideration. Accordingly, the settlement agreement is now final, effective April 7, 2003. Class Counsel will send out a package to class members who are eligible for monetary payments under the Settlement on May 20, 2003 and May 21, 2003. The package includes an estimated payment sheet, the Verification/Correction form, a letter to class members, a release form and an application for the Oversight Committee and Class Advisory Board. A second package will be sent out shortly to those class members who appear ineligible for payments.

Once you receive your package, you will have 15 days to respond andreturn it to class counsel. Class counsel will then make a second attempt to contact non-responsive class members. Once class counsel has made those attempts, the gross amounts to be distributed to each class member will be forwarded to SSA. SSA will make the payments to each class member. The Agency has paid to Class Counsel the amount of attorneys fees as per the Agreement. The amount paid by BMFJ was wired to BMFJ on approximately April 23, 2003. Those class members who contributed monies to BMFJ should have received their distribution by now. BMFJ, not class counsel, is responsible for making those distributions.
