On April 7, 2003, the Equal
Employment Opportunity Commission issued its
final decision in the Campbell appeal denying his request for
reconsideration. Accordingly, the settlement agreement is now final
effective April 7, 2003. Class Counsel will now start the process of
completing the verification forms. These should be mailed out in the
next 3-4 weeks. A copy of the decision is linked below
In two decisions
dated February 20, 2003, the EEOC's Office of Federal
Operations affirmed that the Settlement Agreement is fair, adequate and
reasonable to the Class as a whole. The Office of Federal Operations
considered the fairness of the settlement agreement because of two
appeals filed by two class members. Both decisions are attached. In
its decision in Modlin v. Barnhart, Appeal No. 01A24054, the Commission
found that "the settlement is fair to the class as a whole." The
Commission also dismissed Mr. Campbell's appeal because he had neither
filed written objections to the settlement nor spoke at the "fairness
hearing" before Judge Schreffler.
