Sexual Harassment

Las Vegas, Nevada against the Federal Aviation Administration

In a sexual harassment case against the Federal Aviation Administration, our client was subjected to a severe and pervasive hostile working environment which began shortly after she was transferred to the Las Vegas facility, and which continued throughout her employment there. The hostile environment consisted of repeated sexist comments, sexual innuendo and foul and vulgar language. After she filed her EEO complaint, the agency retaliated against her when it refused to release her to accept a promotion at another facility. Our firm aggressively litigated the case before the EEOC, culminating in a three-day hearing before an EEOC Administrative Judge in Las Vegas. The evidence of a hostile work environment was compelling and overwhelming. Witness after witness testified about different employees who made derogatory, sexist and crude comments about fellow employees; eventually, the agency was reduced to trying to establish that the environment had improved since the complaint was filed. On the third day of the hearing, after the Administrative Judge ruled that she would hear damages testimony, the Agency settled the case. Our client received a retroactive promotion, back pay and full attorneys fees. The most gratifying result: after the settlement was reached, numerous employees thanked our client for standing up and fighting to change this pervasive hostile working environment.
