On February 23, 2007, the Merit Systems Protection Board concurred with the January 2007 decision of the Equal Employment Opportunity Commission finding that Father Henry Heffernan was discriminated against on the bases of religion and reprisal for prior EEO activity when the Department of Health and Human Services fired him on pretextual grounds. The MSPB ordered that HHS cancel Father Heffernan’s termination and to pay all back pay, benefits and interest due since the termination in July 2004.
