STATUS OF BOORD MONETARY CLAIMS

The global settlement of class members’ gender discrimination claims, individually filed pursuant to the claims procedure set forth in the parties’ 2006 settlement, became effective in November of 2007 following final approval by the presiding EEOC administrative judge and expiration of the appeal period.

The Settlement provided for a third party Claims Administrator to evaluate the monetary claim forms prior to further review by Class Counsel. After some delay, Class Counsel received the evaluated forms in mid-June 2008 and will be devoting the following two weeks to reviewing such forms and thereafter working with the statistical and economic expert to devise an appropriate algorithm for distributing the Claims Fund. Such algorithm will take into account each claimant’s maximum attainable damages considering their earnings, claims and the total Fund amount, responses to the monetary claim form, performance reviews, and in two instances, case contribution (such as published interview by the Washington Post).

Once Class Counsel and the expert apply such algorithm to each claim, we will file a motion for approval of the formula and individual awards, the latter under seal, with the EEOC. Concurrently the Claims Administrator will seek to notify class members of projected (not final) awards and for those who have not yet executed and returned releases, require return of such releases. Assuming and following approval by the presiding Administrative Judge, the Claim Administrator will calculate tax withholdings, and cut and distribute award checks. Reminder: If you are a class member and your address has changed, it is solely your responsibility to apprise the Claims Administrator of your new address. The awards process is necessarily dependent on third parties and we are moving it as promptly as possible. We estimate that awards will be distributed in September, but we cannot make any guarantees. We will certainly do our best to effect this and thank you for your patience!

STATUS OF POSITION REVIEW PROCESS

The position review process is still underway with the assistance of third-party expert Dr. Kathleen Lundquist. If you are aware of a current position that you believe is wrongly classified as Special Agent you may file a confidential request for position review and she will examine the classification and recommend reclassification if appropriate. This process is not part of the settlement claims process and damages are not available. It is designed to examine and correct post-settlement classifications over the course of the settlement’s multi-year term.
