July 15, 2003 Update

For the past few months we have been working to obtain the current addresses of every class member to provide them with notice of the Administrative Judge’s decision approving the settlement agreement, as required by the EEOC. At this point, we believe that we have exhausted all reasonable efforts to locate and provide notice to the remaining class members. We must now wait until mid-August for the 30-day time period allowed for these remaining individuals to appeal the decision to expire.

In addition, we have been working with the Agency and our statistical experts to recompute the salaries of retirees who have chosen the re-computed annuity option under Part A of the settlement agreement. We have completed this process and have forwarded the salary information to the Agency to provide to OPM. We hope to learn within the next three to four months whether OPM will approve the re-computed annuities.

The Agency has made the first required payment under the settlement agreement, which is being held in escrow until distributions can begin. At this time, we have sufficient funds and information to make payments under Part B (class contribution) of the settlement formula. In mid- to late- August, we plan to send information to all class members about this first payment. Depending on how quickly we receive complete responses from all class members, we may be able to distribute the first payment by October.
